Introduction:

All materials and services provided by Marie and Maggs Interiors LLC are subject to the following Terms and Conditions. By accessing the Marie and Maggs Interiors LLC website, blog, social media, or other information sharing outlets or by using Marie and Maggs Interiors LLC products or services you acknowledge that you have read our Terms and Conditions. Marie and Maggs Interiors LLC is an online decorating consultation service, this means that we offer suggestions on how to decorate your home to achieve a specific interior design style. All recommendations are regarded as suggestions to improve the look of your space and are not intended for construction purposes.

Jurisdiction:

The terms of this agreement are to be governed by the laws of the State of Pennsylvania. The state and federal courts located in Pennsylvania have exclusive jurisdiction over any case or controversy arising from this agreement and any other information or services provided by Marie and Maggs Interiors LLC. The rights and obligations created under this agreement may not be assigned to any other party.

Disputes:

If any disputes arise concerning your engagement with Marie and Maggs Interiors LLC we both agree to make all reasonable efforts to settle any claim or controversy outside of the public court system prior to initiating any formal complaint in a court of law. You may choose to discharge our services at any time. In the event of discharge, you may be entitled to a refund of all or part of your payment. Similarly, we may choose to terminate our services if a conflict of interest develops or is discovered, or if other circumstances arise that would make our services or representation unlawful, unethical, or otherwise inappropriate. Refunds and partial payments are based on the value of services completed prior to the discharge date.

Reproduction:

Marie and Maggs Interiors LLC retains exclusive copyrights with all rights are reserved for all design projects and they may be used for website/blog content, social media content and any other marketing efforts with prior permission from Marie and Maggs Interiors LLC.

All information and products shared and / or created by Marie and Maggs Interiors LLC may only be reproduced, without changes, for your personal information and educational use. This reproduction must include these Terms and Conditions. All other types of reproduction and use are strictly prohibited.

Enforceability :

In the event that one or more of the provisions of this agreement are found unenforceable, illegal, or invalid, the other provisions of this agreement shall not be affected.

Warranty and Damages:

Information and services provided by Marie and Maggs Interiors LLC via the Marie and Maggs Interiors LLC website, blog, social media, and other information sharing outlets are provided "as is" and "as available" without a warranty of any kind. All information may not always be current, complete, or accurate. Any implied warranty is expressly disclaimed. Marie and Maggs Interiors LLC is not liable to you or others for any damages of any kind arising from the use of Marie and Maggs Interiors LLC services and/or the Marie and Maggs Interiors LLC website, blog, social media and other information sharing outlets. Marie and Maggs Interiors LLC is an online decorating consultation service only. If construction is wanted, the Client is responsible for consulting and separately contracting with a licensed contractor. All documents and images provided by Marie and Maggs Interiors LLC including but not limited to renderings, floor plans, drawings and mood boards given in design projects are conceptual in nature and are intended to set forth design intent; they are not to be used for architectural or engineering purposes. Marie and Maggs Interiors LLC will not be responsible for any action the client takes due to our online design. This includes but is not limited to the means, methods or procedures of construction, fabrication, delivery & installation, or safety precautions in connection with the design project; or for the acts or omissions of the contractor or any, subcontractor, supplier, or other person performing the work on the design project; or, for any failure of them to meet any schedules or completion dates. Marie and Maggs Interiors LLC cannot be held responsible the procurement of items including but not limited to arranging repairs, replacement or shipping claims for purchases made in conjunction with recommendations for the design project.

No Guarantees:

Marie and Maggs Interiors LLC cannot guarantee specific results. Past results are not indicative of future results. Marie and Maggs Interiors LLC cannot guarantee the prices or long-term availability of merchandise listed in a client’s product shopping list.

Additional Fees:

One revision, which shall be limited to replacing items for the same room and in the same style originally agreed upon, is included in every design package. Any subsequent revisions may be purchased for an additional fee. Alternatives for any items that become unavailable on the client’s shopping list following the 2-week design follow-up support period, which begins the day the decorating plan is sent to the client, will only be provided for an additional fee. Consultation on additional design elements of the space may be added to the project for an additional fee.

Client Responsibilities:

Client agrees to provide full information regarding the requirements (i.e., photos, measurements, style inspiration, questionnaire, etc.) for the project. Client is responsible for all project management efforts, this includes but is not limited to the hiring, scheduling, and coordinating of any contractor, subcontractor, supplier, or other person performing work related to the design project.

Returns/Exchanges/Cancellations:

Marie and Maggs Interiors LLC does not accept returns or exchanges due to the nature of the digital design consultation services. Cancellations are permitted if Marie and Maggs Interiors LLC receives the Client's written request to cancel services within 24 hours of receiving payment. A full refund will be provided if these conditions are met.
